Into logyper, here in after the “Service Provider”, and User, here in after the “Client”.
Services Provided
The Service Provider undertakes to provide the services in accordance with the terms and conditions stipulated in this contract. Services may include, but are not limited to, web services, installations, implementations, technical support, online services, and on-site installation services.
Limitation of Guarantees
The Service Provider makes no express or implied warranties regarding the quality, performance, suitability or availability of the services provided. Customer agrees that the services are provided “as is” and that any use of the services is at Customer’s own risk.
Limitation of Liability
The Client acknowledges and accepts that:
3.1. Some parts of the systems and services may experience failures or interruptions due to various reasons, including, but not limited to, technical problems, scheduled maintenance, third-party interference, or events beyond the control of the Service Provider. The Service Provider will not be liable for any damage or loss resulting from such interruptions.
3.2. Third party services that do not depend on the Service Provider, such as hosting providers, third party services, or any other external providers, are not under the control of the Service Provider and will not be the responsibility of the Service Provider.
3.3. If the Service Provider carries out physical work, such as an on-site installation, and the Client is not satisfied with the result, the Service Provider will not refund any payment as this is physical installation work that cannot be undone easily.
Limitation of Damages
The Service Provider will not be liable for any indirect, special, consequential or punitive damages, or for loss of profits or data, arising from the provision of the services or any breach of this contract.
Compensation
The Client agrees to indemnify and hold harmless the Service Provider and its employees, representatives and agents against any claim, demand, loss, liability or expense, including reasonable legal fees, related to the Client’s use of the services.
Applicable Law and Jurisdiction
This contract will be governed by the laws of the country of Principe, and any dispute related to this contract will be resolved in the courts of said jurisdiction.
Acceptance
By using the services provided by the Service Provider, the Customer accepts all the terms and conditions of this contract.
